Terms of Service
The rules, rights and responsibilities that apply to members and visitors.

1. Agreement to these Terms
These Terms of Service (“Terms”) govern access to and use of sugardaddies.au, including its website, accounts, matching features, communications and related services (collectively, the “Service”). “SugarDaddies Australia”, “we”, “us” and “our” refer to SugarDaddies Australia Pty Ltd, the operator of the Service.
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. Additional terms disclosed when you purchase or use a feature also apply to that feature.
2. Adults only
You must be at least 18 years old and legally capable of entering a binding agreement to use the Service. By creating an account, you represent that the information you provide about your age and identity is accurate.
We may request information reasonably needed to confirm eligibility. We may suspend or remove an account if we reasonably believe the user is under 18, has misrepresented eligibility or is using the Service for an unlawful purpose.
3. Nature of the Service
The Service helps adults discover and communicate with other adults. We are not a party to relationships, dates, private understandings, gifts, payments or agreements between members. We do not guarantee that a profile is accurate, that a user will respond, that a relationship will form or that any person has a stated level of income or status.
Generosity does not buy consent, intimacy, exclusivity or control. Members remain responsible for their own decisions and must comply with all applicable laws.
4. Your account
You agree to provide accurate, current information and to keep your profile reasonably up to date. You may not create an account for another person without lawful authority, transfer an account, share login credentials or create a new account to evade a restriction.
You are responsible for activity carried out through your account except to the extent caused by our failure to use reasonable care. Tell us promptly if you suspect unauthorised access.
5. Respectful and lawful conduct
You must treat other members with respect and honour their boundaries. You must not use the Service to:
- harass, threaten, stalk, coerce, exploit, discriminate against or impersonate another person;
- solicit or facilitate sexual services in exchange for money, gifts or other value;
- engage in trafficking, exploitation, non-consensual conduct or activity involving a person under 18;
- request or send money through deception, launder money, recruit money mules or conduct a romance scam;
- publish another person’s private information or intimate content without consent;
- send spam, advertise unrelated services, recruit for commercial schemes or collect member data;
- use bots, scripts, scraping, crawling or automated account-creation tools without written permission;
- upload malware, interfere with security, test vulnerabilities without authorisation or disrupt the Service;
- use the Service in any way that violates applicable law or the rights of another person.
6. Safety and member interactions
Online and in-person dating involve risk. Use your own judgement, protect personal information, verify before meeting and choose public first-date venues. Never send money or financial credentials to a match. Our Safety Guidelines form important guidance for using the Service but cannot eliminate every risk.
You are solely responsible for interactions with other users. Where permitted by law, we are not responsible for a member’s conduct outside our control. Contact emergency services if there is an immediate threat and report relevant conduct to us when safe to do so.
7. Content you provide
You retain ownership of content you submit, such as profile text, photos and messages. You give us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, modify for technical formatting, display and otherwise use that content only as reasonably needed to operate, secure, improve and promote the Service, subject to your settings and our Privacy Policy.
You represent that you have the rights and permissions needed to submit the content and that it does not infringe intellectual property, privacy, publicity or other rights. Do not upload an image of another person without permission.
8. Our content and intellectual property
The Service, excluding user content, is owned by or licensed to us and is protected by intellectual property law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose.
You may not copy, modify, sell, sublicense, reverse engineer or create derivative works from protected parts of the Service except where law permits that activity despite this restriction.
9. Moderation and enforcement
We may investigate reports and use human or automated measures to detect suspected abuse. We may remove content, limit features, require verification, issue warnings, suspend or terminate accounts, preserve evidence and refer matters to appropriate authorities where reasonably necessary.
We are not obliged to monitor every message or resolve private disagreements. Enforcement decisions may consider context, risk, previous conduct and available evidence. We may offer an appeal channel where appropriate.
10. Paid features, billing and renewal
Prices, billing periods, included features and whether a subscription renews automatically must be shown before purchase. If you choose a recurring subscription, you authorise the applicable charge at each renewal until cancellation takes effect.
Cancellation stops future renewal but does not ordinarily reverse charges already incurred. Access may continue until the end of the paid period. Refunds and remedies remain available where required by Australian Consumer Law or other applicable law. App-store purchases, if offered, may also be subject to the store’s billing and refund rules.
11. Consumer guarantees
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Any limitation in these Terms applies only to the maximum extent permitted by law.
12. Service availability and changes
We may add, change or discontinue features and may temporarily restrict access for maintenance, security or operational reasons. We do not promise uninterrupted or error-free availability. If a material change affects a paid service, we will provide any notice or remedy required by law.
13. Third-party services
The Service may link to or depend on third-party providers. We do not control independent third-party sites and their terms and privacy policies apply. A link does not necessarily mean we endorse the provider, content or offer.
14. Disclaimers
To the extent permitted by law, the Service is provided on an “as available” basis. We do not verify every statement made by users or guarantee compatibility, identity, background, financial capacity, conduct or outcomes. Safety features and moderation reduce some risks but cannot remove them.
15. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the Service, member conduct or events outside our reasonable control. Where our liability cannot be excluded, it will be limited only in a manner permitted by applicable law.
This section does not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any right or remedy that cannot lawfully be limited.
16. Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims and reasonable costs arising from your unlawful use of the Service, your content or your material breach of these Terms. This does not require you to indemnify us for our own negligence, unlawful conduct or breach.
17. Ending your account
You may stop using the Service and request account deletion through available account or contact options. We may suspend or terminate access if you materially or repeatedly breach these Terms, create a safety risk, expose us or others to legal liability, or use the Service unlawfully.
Terms that by their nature should continue—such as ownership, permitted retention, dispute and liability provisions—survive account closure.
18. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia. Subject to any forum or right available under mandatory law, the parties submit to the courts of Victoria and courts entitled to hear appeals from them.
Please contact us first so we can try to resolve a concern promptly. This does not remove any right to contact a regulator, consumer protection body or court.
19. Changes to these Terms
We may update these Terms when the Service, law or business practices change. We will update the date above and provide additional notice where required. If you do not agree to revised Terms, you should stop using the Service and cancel any renewal before it is charged.
20. General terms
If part of these Terms is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign them as part of a lawful business transfer, subject to applicable law.
